PA STATE FOP FOUNDATION The application can be completed and emailed to me at jbrinker@pafop.com. The form must be completed and submitted by an FOP Lodge. When completing the form or assisting another to complete the form, please note that the PA FOP Foundation Board of Directors considers some of the following criteria when reviewing a request: A. Does the application provide for assistance to the families and local lodges when law enforcement members are killed in the line of duty? B. Does the application provide for assistance to injured, disabled, sick or distressed law enforcement members? C. Does the application provide for assistance to retired and elderly law enforcement members? D. Does the application provide for the creation of or maintenance of a State Memorial for officers killed in the line of duty? E. Whether or not the beneficiary is sufficiently connected with the Fraternal Order of Police and law enforcement? F. Whether or not the beneficiary in a position of financial distress caused through no intentional fault of his own? G. Whether or not the conditions faced by the beneficiary are beyond the usual experiences of a law enforcement officer or law enforcement officer’s family members? H. Whether or not the conditions faced by the beneficiary evoke a strong sense of sympathy, compassion, and a desire to assist? I. Whether or not the award under consideration will have an appreciable impact on the beneficiary’s quality of life? After I have received the form, it will be presented to the Board of Directors for consideration. I may contact you for additional information if I deem it helpful to supplement your application. I will notify you when the Board acts on the application. On occasion, the Board may request your presence or the presence of others. If that is the case, I will notify you. After the Board takes action, I will notify you in writing whether or not your application has been granted or denied. Fraternally, Jason Brinker Executive Director INSTRUCTIONS FOR APPLICATION 1. Each applicant (always a FOP Lodge) shall complete a written application for benefits on a form approved by the Board of Directors. The Executive Director shall take any action necessary to deliver the application form to any potential applicant. No action on any request for funds from the Foundation shall be considered without submission of such an application, unless distribution was made pursuant to Article VII Section 5 of the Board's bylaws. 2. The application shall require the applicant to submit the following information: A. Name, address, phone number, and other relevant contact information of the applicant. B. Name, address, phone number, and other relevant contact information of the beneficiary, if different from the applicant. C. Supporting reasons for the application for benefits. 3. Each application shall be submitted to the Executive Director. The Executive Director shall review each application and contact the applicant for supplemental information if necessary. The Executive Director shall notify each applicant of receipt of the application and the approximate date when the Board of Directors will consider the application. 4. The Executive Director shall schedule a meeting of the Board of Directors to consider each application, either at a regularly scheduled meeting or at a special meeting. 5. The Executive Director shall provide to each Board member the application and any supplemental information that the Executive Director has obtained. Should the Executive Director elect or upon the Board’s request, an applicant, the beneficiary, or both may appear before the Board in person in support of the application. The Executive Director may recommend that the application be denied or granted, in whole or in part. 6. The Board shall act on each application by applying the following criteria: A. Does the application provide for assistance to the families and local lodges when law enforcement members are killed in the line of duty? B. Does the application provide for assistance to injured, disabled, sick or distressed law enforcement members? C. Does the application provide for assistance to retired and elderly law enforcement members? D. Does the application provide for the creation of or maintenance of a State Memorial for officers killed in the line of duty? E. Does the application provide for payment which is a charitable purpose as that term is defined in Section 501(c) (3) of the Internal Revenue Code? F. Whether granting or denying the application is consistent with the Foundation’s Articles of Incorporation, By-laws, and its status as a tax-exempt organization pursuant to Section 501(c)(3) of the Internal Revenue Code and any other applicable laws? G. Whether or not and how much the beneficiary has received in financial support from any other source, including payments by the Foundation under Article VII Section 5 of its by-laws or otherwise? H. Whether the application meets any other criteria which the Board deems appropriate, provided that it is consistent with Foundation’s charitable purpose, and provided further that the Board shall give primary and preferential consideration to applications which meet criteria A through D? I. Whether the Foundation has sufficient assets to approve the application as submitted? J. Whether or not the beneficiary is sufficiently connected with the Fraternal Order of Police and Law Enforcement? K. Whether or not the beneficiary in a position of financial distress caused through no intentional fault of his own? L. Whether or not the conditions faced by the beneficiary are beyond the usual experiences of a law enforcement officer or law enforcement officer’s family members? M. Whether or not the conditions faced by the beneficiary evoke a strong sense of sympathy, compassion, and a desire to assist? N. Whether or not the award under consideration will have an appreciable impact on the beneficiary’s quality of life? 7. After consideration, the Board shall vote on the application. The Board can approve or grant the application, in whole or in part. The Board has absolute discretion to approve or grant any application, or defer the same, with or without conditions. The Board can grant an application for more or less than the amount requested in the event the application requested a specific amount. 8. After approval, any proceeds may be distributed directly to the beneficiary or to any person or entity for use of the proceeds for the purposes described herein. 9. The Executive Director shall notify the applicant in writing of the Board’s decision as soon as possible after the vote of the Board of Directors. 10. In the event an applicant is dissatisfied with the decision of the Board, the applicant may request that the Board reconsider its decision. The request for reconsideration shall be received by the Executive Director within 30 days from the date the Executive Director notified the applicant of its decision on the application and shall set forth with specificity any additional or supplementary facts not submitted in the original application. The Executive Director shall present the request for reconsideration to the Board at the next meeting for its consideration and action.
